These Terms of Service (“Terms”) govern your access to and use of the public website at divontrix.com (the “Site”), operated by Divontrix Technologies (OPC) Private Limited (“Divontrix”, “we”, “us”). By accessing the Site, you agree to be bound by these Terms. If you do not agree, you may not access the Site.
These Terms cover use of the Site only — submitting the early-access waitlist form, the contact form, and browsing published content. They do not cover any commercial engagement, deployment, licensing, or use of the DivontrixDB product itself, which is governed by separate executed agreements (see Section 04).
Subject to these Terms, Divontrix grants you a non-exclusive, non-transferable, revocable permission to access and use the Site for the purpose of evaluating DivontrixDB, contacting Divontrix about a potential engagement, and reading published content. You may not:
The Site enforces per-IP rate limits on public form routes (3 waitlist submissions per hour per IP; 5 contact messages per hour per IP). Attempts to circumvent these limits are a breach of these Terms.
These Terms do not govern the DivontrixDB product itself. Any licensing, deployment, configuration, support, training, or use of DivontrixDB is governed by separately executed agreements, including:
These documents are executed under engagement and are not publicly available. Nothing on the Site constitutes an offer to license DivontrixDB; an engagement forms only when both parties sign the MSA, EULA, and DPA.
The Site content — including the Divontrix name and mark, the 3Z framework name, page copy, diagrams, code samples, the visual design, and the underlying HTML, CSS, and JavaScript — is the property of Divontrix Technologies and is protected by Indian and international intellectual-property laws.
The 3Z Architecture framework — comprising Zero-Trust Network Access (ZTNA), Zero Attack Surface (ZAS), and Zero Failure (ZF) under heavy workloads — is a Divontrix proprietary framework. The names “3Z Architecture”, “ZTNA-ZAS-ZF”, and the causal-chain presentation (Outcome → Mechanism → Boundary) are Divontrix marks. You may reference them for the purpose of evaluating or describing DivontrixDB; you may not use them to market a competing product.
DivontrixDB source code, build pipeline, and internal repositories are the sole property of Divontrix Technologies. No source code is licensed, escrowed, or shared through the Site. Customers receive compiled, signed binaries only, under the EULA executed as part of an engagement.
When you submit the waitlist form, the contact form, or send us email, you grant Divontrix a non-exclusive, royalty-free, worldwide license to use, store, and process your Submission for the purposes described in our Privacy Policy — namely, to respond to your inquiry, evaluate fit, operate and protect the Site, and meet legal obligations.
You represent that the information you submit is accurate to the best of your knowledge, that you are authorized to submit it on behalf of any organization you name, and that your Submission does not infringe the rights of any third party.
We do not use Submissions to train machine-learning models. We do not share Submissions with third parties except as required by law or as described in the Privacy Policy (sub-processors used for email delivery).
The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Divontrix disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Divontrix does not warrant that the Site will be uninterrupted, error-free, secure, or that any information on the Site is accurate, complete, or current. The Site is informational; nothing on the Site constitutes technical, legal, or regulatory advice. You should not act on Site content without independent verification appropriate to your context.
Specifically, the pricing information published on the Site ($1M baseline, 5-year tenure) is indicative. Actual engagement pricing, scope, and terms are confirmed in the executed MSA. The compliance framework mappings referenced on the Site are alignment statements, not certifications — Divontrix holds no formal certifications at the time these Terms are effective.
To the maximum extent permitted by applicable law, in no event shall Divontrix be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Site — whether in contract, tort, under any theory of liability, or otherwise — even if Divontrix has been advised of the possibility of such damages.
Divontrix’s aggregate liability arising out of or related to your use of the Site shall not exceed the greater of (a) the amount you have paid to Divontrix for access to the Site in the twelve months preceding the claim, or (b) USD $100. Because the Site is offered free of charge, in most cases this cap will be USD $100.
This limitation does not apply to liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or liability for fraud or fraudulent misrepresentation.
You agree to indemnify and hold harmless Divontrix, its directors, officers, employees, and agents from and against any claim, demand, loss, damage, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party in connection with your use of the Site.
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-laws principles. The courts of Telangana, India shall have exclusive jurisdiction over any dispute arising out of or related to these Terms or your use of the Site.
For Users located outside India, you submit to the jurisdiction of the courts of Telangana, India for any dispute with Divontrix arising from the Site. Nothing in these Terms affects any rights you may have under the mandatory consumer protection laws of your country of residence.
Divontrix may suspend or terminate your access to the Site at any time, with or without cause, including if we believe you have breached these Terms. Upon termination, the permission granted in Section 03 ceases immediately.
Sections 05 (Intellectual property), 07 (Disclaimers), 08 (Limitation of liability), 09 (Indemnification), 10 (Governing law), and 12 (Changes) survive termination.
We may update these Terms from time to time. When we do, we will update the “Effective” date at the top of this page. For material changes that reduce your rights or increase your responsibilities, we will post a notice on the Site’s homepage at least 30 days before the change takes effect.
Your continued use of the Site after a change takes effect constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you should stop using the Site.
